Changes to various ANZ Terms and conditions

Effective on and from the 19 February 2024, we will be making changes to some of our Terms and Conditions booklets (‘Terms and Conditions’). The relevant sections to the Terms and Conditions will be updated as outlined below.

Latest update

For customers who added their ANZ Card to their Digital Wallet on their mobile device or digital watch between 8 November 2023 and 25 January 2024 all changes to the Terms and Conditions apply.

For customers who added their ANZ Card to their Digital Wallet on their mobile device or digital watch between 26 January 2024 and 19 February 2024 changes to the date of the Terms and Conditions apply only.

Apple Pay™

Insert a new sub-heading in this section, after the first warning statement and before the first paragraph, with the following:

(a) Your responsibilities

Insert a new dot-point two in this section with the following:

  • if a Cardholder becomes aware that another person is or may be able to access the Apple Device using their biometric information, the Cardholder must use a passcode instead of a Biometric Identifier to initiate transactions using their ANZ Card on Apple Pay and must remove their Biometric Identifier from the Apple Device;

Insert a new sub-dot-point three in this section with the following:

  • if you or Another Cardholder think any other person knows the passcode for the Apple Device, you must ensure that the passcode is changed by you or Another Cardholder, as applicable;

Insert a new sub-heading in this section before the sentence “If a Cardholder:” with the following:

(b) Transactions which are taken to be authorised

Delete the following from the final dot-point before the second warning statement, and insert as new paragraph:

you are taken to have authorised that person to transact on your account using Apple Pay.

Delete the first paragraph after the second warning statement in this section.

Delete the second paragraph after the second warning statement in this section.

Insert a new sub-heading before the words “Please call us immediately” in this section with the following:

(c) What you must report to ANZ

Replace the first paragraph under new sub-heading (c) in this section with the following:

You must report the following to ANZ by calling us immediately on 1800 033 844 (24 hours a day) if:

Insert a new sub-heading before the words “Based on your report…” in this section with the following:

(d) Consequences of reporting and delayed reporting

Replace the first sentence within the first paragraph under new sub-heading (d) in this section with the following:

If you report any of the circumstances in clause 3 (c) above, we will suspend use of your ANZ Card with Apple Pay.

Insert a new sub-heading before the words “In the terms of the Account Terms…” in this section with the following:

(e) Unauthorised transactions

Insert a new first paragraph after the section heading with the following:

At any time, a Cardholder can delete or suspend their ANZ Card from Apple Pay. You cannot suspend the use of Another Cardholder's ANZ Card in Apple Pay, but you can suspend or close the ANZ Card of Another Cardholder by calling 1800 033 844 (24 hours a day).

Insert a new dot-point two in this section with the following:

  • If you report any of the circumstances in clause 3(c) above;

Delete dot-point four in this section and replace with the following:

  • If you breach these terms;

Delete dot-point eight in this section and replace with the following:

  • If reasonably necessary to protect ANZ’s legitimate business interests, for example where we reasonably suspect unlawful activity or misconduct on your ANZ Card in Apple Pay.

Insert a new paragraph after dot-point eight in this section with the following:

Unless required by law, or where it is reasonably practicable to do so, we will not give you notice prior to blocking, suspending or terminating your ANZ Card in Apple Pay.

Delete the second to last paragraph in this section.

Delete this entire section and replace with the following:

We are not responsible for the functionality or availability of Apple Pay, its compatibility with contactless terminals, or the availability of Apple's third-party communications and network providers (except to the extent that we are deemed liable under the ePayments Code).

ANZ's obligation to you in relation to the functionality of Appley Pay is limited to securely supplying information to Apple in order to allow use of an ANZ Card through Apple Pay.

Limitations on ANZ’s liability to you are set out in clause 8.

You will need to agree to Apple's terms and conditions in order to use Apple Pay.

Insert a new first paragraph after the section heading with the following:

ANZ is not liable for any loss or damage you suffer due to the supply of information to Apple, except to the extent any loss or damage arises from the negligence, fraud or wilful misconduct by ANZ or its officers, employees, contractors or agents.

Delete section heading and replace with the following:

9. We can make changes to these terms without your agreement

Insert a new paragraph two in this section with the following:

If we make a change you are not prepared to accept, you can remove your ANZ Card from Apple Pay on your Apple Device. Instructions on how to remove an ANZ Card from Apple Pay are set out at www.anz.com/applepay.

Delete section heading and replace with the following:

10. Electronic communication

Delete this entire section and replace with the following:

Without limiting any other means of communicating with you under the Account Terms, we may communicate with you by sending an SMS to the telephone number you have provided us, an email to the email address you have provided to us or by writing to you at the address you have provided to us. The SMS or notice may include a link to detailed information on our website.

Google Wallet (Fitbit device)

Delete the term “Google Pay” and replace with the term “Google Wallet” throughout entirety of the Terms and Conditions.

Insert a new paragraph four in this section with the following:

If a Cardholder no longer wishes to use an ANZ Card with Google Wallet on a particular Fitbit Device that card has been added to, the Cardholder can delete the ANZ Card from Google Wallet using the Fitbit Device on a paired Mobile Device, or deactivate Google Wallet online through the Cardholder’s Google account at www.google.com.

Insert a new paragraph five in this section with the following:

If a Cardholder no longer wishes an ANZ Card to be used with Google Wallet on any Fitbit Device that card has been added to they should ensure the ANZ Card is deleted from Google Wallet on each Fitbit Device the ANZ Card has been added to.

Insert a new paragraph six in this section with the following:

If a Cardholder no longer wishes to use any card added to Google Wallet via the Fitbit Device they can:

  • remove the relevant cards from Google Wallet and delete or uninstall Google Wallet on their paired Mobile Device; or
  • undertake a factory reset of the Fitbit Device and delete or uninstall the Fitbit Pay app on their paired Mobile Device; or
  • deactivate the Fitbit Device online through the Cardholder’s Fitbit account at www.fitbit.com.

Insert a new sub-heading in this section, after the first paragraph, with the following:

Garmin Pay™

If a Cardholder no longer wishes to use an ANZ Card with Garmin Pay on a particular Garmin Device that card has been added to, the Cardholder can delete the ANZ Card from Garmin Pay using the Garmin Connect Mobile App on a paired Mobile Device.

Insert a new paragraph five in this section with the following:

If a Cardholder no longer wishes an ANZ Card to be used with Garmin Pay on any Garmin Device that card has been added to they should ensure the ANZ Card is deleted from Garmin Pay on each Garmin Device the ANZ Card has been added to.

Insert a new paragraph six in this section with the following:

If a Cardholder no longer wishes to use any card added to Garmin Pay with Garmin Pay they can:

Insert two new dot-points after new paragraph six in this section with the following:

  • Remove the relevant cards from the Garmin Device and delete or uninstall the Garmin Connect Mobile App on their paired Mobile Device; or
  • Restore defaults on the Garmin Device and delete or uninstall the Garmin Connect Mobile App on their paired Mobile Device.

Google Pay™

Delete the term “Google Pay” and replace with the term “Google Wallet” or “Android Device” throughout entirety of the Terms and Conditions (including the document title).

Insert a new paragraph below dot-point four in this section with the following:

It may be possible to make transactions using Google Wallet with your Android Device after deleting/uninstalling Google Wallet on your Android Device. As a result, if you no longer wish to use an ANZ Card with Google Wallet, you should remove the ANZ Card from the Google Wallet prior to deleting/uninstalling Google Wallet on your Android Device. Other ways you can ensure that your ANZ Card cannot be used with Google Wallet on your Android Device include:

  • Removing the Google account to which the ANZ Card was added in Google Wallet;
  • Undertaking a factory reset of your Android Device; or
  • Erasing your Android Device on Android Device Manager.

Delete the words “on an account” in this section.

Delete the words “in an application” in this section and replace with the following:

“for an online payment”

Delete the words “transactions in applications” in this section.

Insert a new sub-heading in this section, after the first paragraph, with the following:

Google Wallet is provided by Google, not by ANZ.

We are not responsible for the functionality or availability of Google Wallet, its compatibility with contactless terminals, or the availability of Google's third-party communications and network providers (except to the extent that we are deemed liable under the ePayments Code).

Samsung Pay™

Delete the term “Samsung Pay app” and replace with the term “Samsung Pay” throughout entirety of the Terms and Conditions.

If a Cardholder no longer wishes to use an ANZ Card with Samsung Pay on a particular Samsung Device, the Cardholder can delete the ANZ Card from Samsung Pay on that Samsung Device.

Insert a new paragraph four in this section with the following:

If a Cardholder no longer wishes an ANZ Card to be used with Samsung Pay on any Samsung Device that card has been added to they should ensure the ANZ Card is deleted from Samsung Pay on each Samsung Device the ANZ Card has been added to.

Insert a new paragraph five in this section with the following:

If a Cardholder wants to ensure all cards (including any ANZ Card) added to Samsung Pay on a Samsung Device cannot be used with Samsung Pay on that Samsung Device they can also:

  • Uninstall Samsung Pay from that Samsung Device;
  • Undertake a factory reset of the Samsung Device; or
  • Reset the Samsung Device or wipe Samsung Pay using Find My Mobile.

Delete the second last paragraph in this section and replace it with the following:

A Cardholder can remove an ANZ Card linked to your account from Samsung Pay on the Cardholder’s Samsung Device at any time.
